The merchant above is the seller and contracting party responsible for customer orders placed through Scootory. Shopify and delivery carriers are not the seller.
2.1 Scope
These Terms and Conditions of Sale (“Terms”) apply to purchases made through scootory.shop. They govern the contract between the customer (“you”) and Scootory. Mandatory consumer-protection law applicable in the customer’s country of habitual residence prevails over any conflicting provision of these Terms.
2.2 Eligibility
You must have legal capacity to enter into a binding contract. If you order on behalf of a business or another legal person, you confirm that you are authorised to bind it. Consumer-only rights in these Terms apply only where you act mainly for purposes outside your trade, business, craft or profession.
2.3 Product information
We seek to present products accurately. Images may illustrate the product from several angles and packaging may change. Colour may vary by display. The product title, confirmed compatibility, technical specifications, variant, quantity and package contents shown at checkout form part of the offer.
No customer review, third-party statement or general marketing statement changes confirmed compatibility or technical specifications unless we expressly incorporate it into the product description. Customers should contact us before purchase when a model revision, connector or specification is uncertain.
2.4 Prices, taxes and import charges
Prices are displayed in euros unless another currency is selected. Before the order is submitted, checkout will show the total price, applicable taxes, delivery charge and any other mandatory charge known to us.
Prices include VAT where applicable. All delivery charges and every other mandatory charge payable to Scootory will be displayed before the order is submitted. No undisclosed surcharge will be imposed after the order is placed. If a destination could lawfully expose the customer to a customs duty, import tax or carrier charge not collected by Scootory, that charge and the person responsible for paying it must be disclosed clearly before payment; otherwise, the customer will not be asked to bear an undisclosed import charge on delivery.
2.5 Ordering process and correction of errors
Products placed in the cart are not reserved. Before submitting an order, you can review and correct the products, variants, quantities, delivery address and payment details. The checkout button will clearly indicate that placing the order creates an obligation to pay.
2.6 Contract formation
Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. The contract is formed when we send an express order confirmation or dispatch confirmation, or when we dispatch the goods, whichever occurs first. We may reject an order before acceptance for legitimate reasons, including an obvious pricing error, failed payment, unavailable stock, sanctions/export restrictions, inability to deliver, suspected fraud, or a product-safety concern. If payment has already been taken for a rejected order, we will refund it promptly to the original payment method.
2.7 Payment
The payment methods available for your order are displayed at checkout before the order is submitted. Payments are processed through secure third-party payment providers identified at checkout. We do not receive full payment-card numbers when the payment provider tokenises or independently processes them.
2.8 Availability and order limits
Availability information is updated in good faith but is not a guarantee until acceptance. We may apply reasonable per-customer or per-order quantity limits to protect supply, prevent fraud or comply with law. If only part of an order is unavailable, we will ask whether you prefer shipment of the available items or cancellation of the affected items, unless the order can lawfully be cancelled and refunded in full without disadvantaging you.
2.9 Delivery
Delivery destinations, methods, prices and estimated timeframes are displayed at checkout and summarised in the Shipping and Delivery Policy. Unless a different period was expressly agreed, consumer orders will be delivered without undue delay and no later than 30 days after conclusion of the contract. Risk of loss or damage passes to a consumer when the consumer, or a person designated by the consumer other than the carrier, physically receives the goods. This rule does not apply where the consumer independently commissioned a carrier not offered by us.
2.10 Installation and safe use
Replacement parts must be installed and used according to the manufacturer’s instructions, technical specifications and applicable law. Electrical, battery, motor, controller, braking and structural components may require a competent technician. Never install a component with an incompatible voltage, connector, current/power rating, dimension or firmware.
Instructions and warnings are not a waiver of liability. Nothing in these Terms excludes responsibility for an unsafe, defective, misdescribed or incorrectly supplied product where liability cannot lawfully be excluded.
2.11 Right of withdrawal
EU/EEA consumers and other consumers granted equivalent rights by applicable law may withdraw from an eligible distance contract without giving a reason within 14 days after the day on which the consumer, or a nominated third party other than the carrier, receives the goods. For one order delivered in multiple lots, the period begins after receipt of the final lot.
To exercise the right, send a clear statement to support@scootory.shop, use the online “Withdraw from contract” function, or submit the model form before the period expires. After notifying us, return the goods within 14 days to the return address we confirm to you in writing.
The detailed rules, exceptions and refund process are in the Returns, Withdrawal and Refund Policy and form part of these Terms.
2.12 Statutory conformity guarantee and complaints
Consumer purchases are protected by the mandatory statutory conformity guarantee applicable in the delivery country, including a minimum two-year protection under EU rules for new goods. This statutory protection is free and is separate from any optional commercial warranty. If goods are defective, unsafe, damaged on arrival, incorrectly supplied, or do not match the contract, contact support@scootory.shop promptly with the order number and evidence reasonably necessary to assess the claim.
Available remedies are determined by mandatory law and may include repair or replacement free of charge, an appropriate price reduction, or termination and refund. Scootory bears the necessary return cost for goods validly rejected as defective or non-conforming. We do not require a consumer to pursue another business instead of Scootory.
Normal wear, accidental damage, misuse, unauthorised modification, incorrect installation, use outside published specifications, or damage caused by an incompatible scooter revision is not a product defect unless the problem resulted from inadequate instructions, inaccurate compatibility information or another matter for which Scootory is legally responsible.
2.13 Recalls and safety corrective actions
We may contact customers about safety warnings, firmware issues, corrective actions or recalls. Customers must follow safety instructions promptly. A safety remedy or recall will be provided without charge where required by law. Do not discard a potentially unsafe item unless instructed, because traceability or return may be necessary.
2.14 Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory product-safety or consumer law, defective products where liability cannot be excluded, or any other liability that law does not permit us to exclude.
To the fullest extent permitted by law, we are not liable for losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by a consumer. For business customers only, and only where lawful, aggregate contractual liability is limited to the amount paid for the affected order; this limitation does not apply to liabilities that cannot lawfully be limited.
2.15 Events beyond reasonable control
We are not responsible for delay caused by events genuinely beyond our reasonable control, but we will take reasonable steps to minimise delay and inform affected customers. Mandatory rights to terminate for serious delay remain unaffected.
2.16 Promotions and discount codes
Promotions are subject to their published conditions. Unless stated otherwise, codes have no cash value, cannot be combined, apply only to eligible items during the stated period, and may be limited to one use per customer. We may cancel a promotion affected by a genuine technical or pricing error, but will not retrospectively increase the price of an accepted order without the customer’s agreement.
2.17 Reviews
Reviews must reflect a genuine experience and must not be unlawful, abusive, deceptive, incentivised without disclosure, or contain another person’s personal information. We may moderate reviews for these reasons. We will not suppress a review merely because it is negative. Where we claim that reviews are verified, we will use reasonable and proportionate steps to verify that claim.
2.18 Changes to these Terms
The version in force when the order is placed governs that order. We may update future versions for legal, operational or security reasons. Material changes will not retrospectively reduce rights under an existing contract.
2.19 Governing law and disputes
These Terms are governed by French law, without depriving a consumer of mandatory protections under the law of the consumer’s country of habitual residence. A consumer may bring proceedings in any court that has jurisdiction under applicable consumer law.
Before using mediation, the consumer must first submit a written complaint to support@scootory.shop. If the dispute is not resolved, the consumer may refer it free of charge to a consumer mediator, subject to that mediator’s admissibility rules; write to us and we will provide the appointed mediator’s current name, postal address and website. The former EU Online Dispute Resolution platform is no longer an active complaint portal and is therefore not linked here.
2.20 Severability and entire agreement
If part of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent lawful. The order confirmation, applicable product page, these Terms, and the policies expressly incorporated into them form the contract. No provision limits rights arising from statements on which a consumer reasonably relied where applicable law makes those statements binding.
